When you read reports of significant job losses and layoffs in the mining and petroleum sectors, in particular the announcement by Suncor Energy’s CEO that Suncor intends to eliminate a further 1,500 oil & gas jobs by year’s end, it is important to consider your own position should you lose your job in the mining or petroleum sector. For the harsh reality is that most employees that are fired, terminated, laid off, or otherwise exit their job in the oil & gas or mining industry will not receive anywhere close to the full amount that they are legally due. And this assessment can be made with considerable confidence based on information and materials that these very companies have made publicly-available and have shown little consideration for how it might be used by an innovative lawyer, who has taken the time to read and analyze what these mining and oil & gas companies have publicly stated.

This is particularly true when your employment was characterized by one or more of the following factors: (i) employment in the petroleum or mining sector, (ii) salaried employment or working in the field, (iii) long-term employment, (iv) large employer, including publicly-traded companies, and (v) employed in Alberta. Naturally, the individual facts and circumstances will determine whether or not a terminated employee is due significantly more than what they are being offered, however, these have been particularly strong indicators in our professional experience.

So, when you are presented with a termination, severance or layoff package, you shouldn’t look to accept it all too quickly, when there is actually a strong possibility that you are due far more than what you are initially being offered. But you won’t know if you are due an increase in your pay-out, which can be quite significant, unless you take the time to contact a knowledgeable lawyer that knows what to be looking for and can properly explain what you are due and why you are legally entitled to receive it.

Our approach, however, is not for everyone. When we take on an employment case, we pursue it very aggressively, such that we don't pull our punches with your former employer. As such, for those individuals who simply want to move on, even if it means leaving behind a considerable amount of money, we are probably not the right legal team. For everyone else, especially those employed by oil & gas / mining companies (who think they are so strong and powerful to be beyond reproach), that meet our internal criteria for aggressive employment litigation, we have a unique legal approach that you should seriously consider. If this is of interest to yourself, feel free to contact our law firm in strict confidence, by telephone at 403-400-4092 or 905-616-8864, or via email at Chris@NeufeldLegal.com.
