The unilateral action of the compulsory release of Canadian Armed Forces members would appear to be a nearly unassailable task for the discharged officer or non-commissioned military service member; although, that is merely what the federal government would have you believe. The compulsory release of CAF members, for alleged or perceived 'performance failure', 'non-compliance' with the Universality of Service, medical, 'disciplinary' and/or 'administrative' issues is a unilateral and biased interpretation of the underlying events and the Canadian Armed Forces' Release Authority, that represent the end of your military career; however, what you are paid out is subject to considerable legal scrutiny. The finality of a compulsory release for a Canadian Armed Forces officer or non-commissioned member should not be extended to the determination of one's financial payout, which is subject to determinative forces outside of the absolute control of one's military overlords and the federal government. Instead, these are matters of legal interpretation and mathematical computations, which are properly resolved by lawyers that understand the actual particulars of the law, and are adjudictated before the courts. And yet, this would appear to have been lost to many former Canadian Armed Forces members who have been unceremoniously released and have made no proper effort to investigate their military payout and pursue the full amount that is due to those discharged military service members. The federal government and the leadership of the Canadian Armed Forces have been incredibly successful in manipulating perceptions of military service members, while imposing systems and processes that deter challenges to their operational procedures, which has only recently come under scrutiny from the Canadian Armed Forces Ombudsman (although he had only touched upon the more visible issues, without tackling what we view as the more substantive issues that have the greatest financial impact for CAF officers and non-commissioned members, yet remain unidentified and continuing to cause substantial financial harm to those CAF officers and non-commissioned members). If you are a Canadian Armed Forces officer or non-commissioned member whose military service career has come to an end through a compulsory release, even in the past few years, and are prepared to scrutinize and challenge what you are owed, contact our law firm to schedule a free confidential initial consultation at Chris@NeufeldLegal.com or 403-400-4092 / 905-616-8864. |
